2010 DanceDanceRevolution US Championship Official Rules
SUMMARY: The 2010 DanceDanceRevolution US Championship is a Three Tier program of Live Events leading to the 2010 DanceDanceRevolution US Championship competition (also referred to as the “Tournament”). Tier One of the tournament consists of the 2010 DanceDanceRevolution Round One tournaments (Round One). The Round One tournaments are the pre-Qualifier tournaments leading to Round Two. Round One tournaments are third Party Partner Hosted Tournaments (Round One Partners) and will take place around the country. The First, (1st), Second, (2nd), and Third (3rd) Place Winners of each 2010 DanceDanceRevolution Round One tournament, upon meeting all criteria as defined herein, shall be eligible to compete in Tier Two of the tournament. Tier Two is Round Two and consists of the 2010 DanceDanceRevolution US Championship Round Two Regional Qualifier Tournaments (Round Two). There will be between eight (8) and ten (10) Round Two tournaments at locations around the country. Round Two is followed by the Round Three 2010 DanceDanceRevolution US Championship Finals (Round Three). The Round Three Finals will take place at a single location on Saturday, December 4, 2010. In order to qualify for the Round Three finals, registered participants must BOTH win their Round Two tournament AND score one of the top four scores from amongst all Round Two tournaments. Round One tournament will be played on the version of DanceDanceRevolution the Round One Partner has at its location. For Round Two and Round Three, the game version will be the most recent release of DanceDanceRevolution. Round Two and Round Three will be played on the Official Konami Dance Pads. However, the Tournament Administrator may substitute any version of the game required to complete any aspect of the Tournament. The 2010 DanceDanceRevolution 2010 DanceDanceRevolution Round One tournaments shall be conducted between August 1, 2010 and Sunday, October 9, 2010. Round two shall be conducted between October 10, 2010 and Sunday, November 20, 2010. Round Three, the finals will be held on Saturday, December 4, 2010.
Assuming a participating location, meets the eligibility requirements defined herein, the tournament shall be open to Participants based on the following Age Divisions: (1) the Youth Division shall consist of Participants in age division eight (Age 8) through twelve (Age 12), (2) the Teen Division shall consist of Participants in ages group thirteen (Age 13 ) through eighteen (Age18 ), (3) the Adult Division shall consist of Participants in ages eighteen (Age 18) through thirty-two (Age 32). Round One of the of the 2010 US DanceDanceRevolution tournament will take place in eligible third Party Participating Partner Locations across the United States, and will be administered by Administrators/Partners and/or appropriate designated persons who have already completed the Round One Training Program for general use of the DanceDanceRevoluton Product in their respective locations. Tournament times and locations for the Round One tournaments will be decided by eligible individual locations based on the Round One Play Window (August 1, 2010 through October 9, 2010), their compliance with Tournament Administrator Training, and Agreement to follow the Official Rules as detailed herein. The first, second and third place Winners of each Round One, from each location, upon meeting all criteria as defined herein, shall be eligible to compete in Round Two of the Tournament. All rounds shall be conducted with Konami Digital Entertainment, Inc. equipment and software, however, the Tournament Administrator may substitute any version of the game required to complete any aspect of the Tournament. For Round Two of the Tournament there are between Eight (8) to Ten (10) Regional tournaments in all. The First (1st), Second (2nd) and Third (3rd) Place Winners from each Round One Division are eligible to participate in each Round Two event. The WINNER OF EACH CATEGORY that have won BOTH THEIR CATEGORY AND HAS ONE OF THE TOP OUR SCORES FROM ALL REGIONALS will be invited to Round Three. Round Three of the tournament, the finals shall consist of the top winners in each category that have won both their age division and has one of the overall top scores from Round Two. In order to qualify for the US Finals; you must win your age group and have one of the top four scores nationally, competing in the 2010 DanceDanceRevolution US National Championship Tournament. The Top finishers nationally from each Round two events are eligible to participate in Round Three. Tournament administrators will determine if any exception is to be made for any location, seeking to participate in the tournament which does not meet the specifications as defined herein at their sole discretion. Minor children are allowed to participate in the Tournament. Please see the section on the Entry of Minors for more information on how minors can enter the Tournament. Review these Official Rules carefully as all Entries and Prizes are subject to the Rules, including without limitation, the Selection Procedures set forth herein. Each participant must be eligibility according to the rules set herein, at the time of participation at each Tournament.
2. ELIGIBILITY: The following applies to the ways to participate in the 2010 DanceDanceRevolution US Championship. There are two ways to participate. These are as an Individual Participant or as a Round One Partner.
INDIVIDUAL PARTICIPANT ELIGIBILITY: In order to participate each registered participant must be (1) a natural person legally residing in, and physically located within, the Continental United States; (2) attend an eligible participating Third Party Partner Tournament Locations; (3) must be in ages eight (Age 8) through thirty-two years of age (Age 32); (4) be ready, able and willing to travel to the next round to compete; (5) be willing to have his/her name, likeness and biographical information published on the Website, or otherwise distributed, in connection with, or to promote, the Tournaments; and (6) not be an employee, consultant, independent contractor or intern who has, within the past six (7) months, performed services for, Sponsor, Administrator or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Tournaments or supplying the Prizes, or their respective parent, subsidiary, affiliated or successor companies (collectively, “Entities”), nor a member of their household or immediate family. “Household members” shall mean people who share the same residence at least three months a year and “immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. Children of Round One Administrators are eligible to participate in the Tournament so long their participation is not administered by their parent, legal guardian, or immediate family member.
ROUND ONE PARTNER ELIGIBILITY: To be eligible to participate as a Round One Partner, you must register your organization or group through the partner registration process at http://www.ddruschampionship.com/partner_reg.html to participate in Round One as a Round One Partner. Once registered, each Round One Partner the Administrator must go through the training process, execute, and report their results for their Round One Tournament being held at their location.
3. HOW TO ENTER: Both Individual Participants and Round One Partners must register at http://www.ddruschampionship.com/index.html. During registration, both Individual Competitors and Round One Partners must answer all required questions accurately, agree to accept the Official Rules, and take part in the tournament according to the tournament schedule.
4. ENTRY OF MINORS: Minor participants are defined as persons under the age of eighteen (18) years of age as of the time of registration. Individual Minors may register at http://www.ddruschampionship.com/register.html. All Minor Registrant’s are required to have permission from their Parent or Legal Guardian in order to participate via registration as an Individual Participant or as a participant in a ROUND ONE TOURNAMENT. Round One Administrators will report online the names of Minor Winners from their tournament. Tournament Administrators will provide the names of the Winner and their Parent or Legal Guardian as part of their Tournament Results Report. Tournament Administrators shall provide the name and contact information for all Winners as well as their parent or legal guardian. All Winners under the age of eighteen (18) years old shall be deemed, for the purposes of the Tournaments, to be MINORS and will require Parental Permission in order to participate beyond Round One. Persons under the Age Level 8 (Age 8) shall be deemed not eligible for participation. In order for a Minor to participate in Round Two and Round Three, a Parent or Legal Guardian must complete the Online Permission Process as follows: (1) Reply to the Notification sent to said Parents or Legal Guardian from Tournament Administrators; (2) Enter all participant information required including but not limited to (a) the Minor Participant’s first and last name , (b) the Minor Participant’s Parent or Legal Guardian’s Full Name, (c) the Parent or Legal Guardian’s phone number, (d) the Parent or Legal Guardian’s email address, Age, and date of birth, and (e) answer “YES” to the Parental Consent check box, by so doing parents or legal guardians are giving consent to all consecutive rounds of the tournament. Upon completion of this process, the Administrator will provide the Minor Registrant Parent or Guardian with an email confirming their registration for the Tournament. ALL MINOR REGISTRANTS must be accompanied by their Parent or Legal Guardian to all rounds of the Tournament. The Parent or Legal Guardian of any Minor Registrant must be present at tournaments check-in and must present valid identification at check-in order for the Minor Registrant to compete in the Tournament. Sponsor and Administrator take the protection of Minor Registrants very seriously. Administrator shall, at its sole discretion, disqualify any Minor Participant, based on any suspicion of fraudulent attempts to manipulate the Minor Registration process.
5. LIMITATIONS: Review these Official Rules carefully as all Entries and Prizes are subject to the Rules, including without limitation, the Selection Procedures set forth herein. Each participant must be eligibility according to the rules set herein, at the time of participation at each Tournament. No outside parties, including parents/legal guardians (“Parent”) may aid, assist advice and/or otherwise help any participant during any portion of the Tournament. Any assistance will result in the immediate disqualification of the registered participant. Each participant must compete in the Tournament entirely on their own. If a participant wins, their respective Round One, that participant must compete in the Round Two to maintain their eligibility for the final round. Once an email address has been submitted for the Tournament, that email address cannot be used by any other person for participation. With exception to parents or legal guardians of minor children as described herein; who may have more than one child participating. Only the participant who entered under a particular email address may participate in the Tournament. During registration, all information must be completed in full. Entry information will be retained until the end of the Tournament and until the Winners, have been determined and prizes have been awarded. Participants who opt in to receive additional information from Sponsor will have their registered information transferred to the appropriate Sponsor at the conclusion of the program. Entries by any method other than set forth above herein are void. Any use of automated or programmed methods of effecting participation is prohibited. Neither the Entities (Sponsor, Administrators, or their assigns), nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releases”) are responsible for Entries from persons residing, or physically located, outside the Territory defined herein; Entries that are altered, delayed, deleted, destroyed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, late, lost, misrouted, multiple, mutilated, non-delivered, postage-due, stolen, tampered with, unauthorized or unintelligible; or any printing, production, technical, electronic or other errors; or for telephone, telecommunications, hardware or third party software malfunctions; failures, or difficulties of any kind; any failed, partial or garbled computer transmissions; technical failures of any kind, including, but not limited to electronic malfunction or damage of any network, hardware or software; any condition caused by events outside of Sponsor’s control; any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure; any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment or software; failure, misdirection or delay of any e-mail or electronic Entry to be received on account of technical problems or traffic congestion on the Internet or on the Website, or any combination thereof, or other errors of any kind, whether due to electronic, mechanical or human error or other causes, even if caused by the negligence of any of the Releases, shall be deemed inappropriate for registration and thereby shall be disqualified. Each of such potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
6. EQUIPMENT, TOURNAMENT DETAILS: During all Round(s) of the Tournament, competitors will use DanceDanceRevolution game system provided to conduct the tournament, according to the game rules outlined in the Official Rules of the 2010 DanceDanceRevolution US Championship Tournament. Round One Partners may execute their Round One Tournament on the equipment at THEIR FACILITY OR LOCATION in accordance with the Official Rules herein. For Round Two and Round Three, the tournament shall be executed on the most recent version of DanceDanceRevolution on the Sony PlayStation and on Official Konami Pads. The Official Winner will be named once the prospective winner fulfills the “Victory Conditions” outlined herein. During the 2010 DanceDanceRevolution US Tournament, in case of rule violations and/or a discrepancy, participants must raise their hands and call for the Judge to make a judgment. The Judge holds the power, in his/her sole discretion, to make a judgment based on the OFFICIAL RULES. No outside parties, including Parents, supporters, or attendees can disturb, disclose information or provide advice to others at any time during the match. In case of a Competition error, the Judge will make a ruling. Judge can rule to restart the Competition or to rule against the Participant who caused the error. Any incident that occurs that is not listed here will be ruled on by the Judge and the Participant must follow the ruling made by the Judge. If any Participant(s) behaving in an unsportsmanlike manner (determined by Sponsor and/or 2010 DanceDanceRevolution staff in their sole discretion), he/she will be disqualified.
7. OVERVIEW OF 2010 DANCEDANCEREVOLUTION US TOURNAMENT ROUND ONE (1) Summary: The 2010 US DanceDanceRevolution Tournaments (“Round One”) are being conducted in the United States at Third Party Partners locations that are eligible to participate according to the terms and conditions herein. Round One (1) will be conducted on location premises during Official Location, Hours at a time and date designated each individual location. Each Participant will select one song from the list of three (3) songs on the preset song list to compete too. The fourth (4th) song on the preset song list will be used for Tie-Breakers only. A tie-breaker occurs when two participants have the same score and therefore there is no clear winner. Any and all scores resulting in a tie will result in a Tie-Breaker round using the fourth-song from the preset list and predetermined Difficulty and Arrow Speed based on criteria herein. Tie-breakers will be conducted immediately following each round of play, with high score determining the winner of the tie-breaker. All participants will have one turn of Play or best 2 out of 3 as tournament administrator sees fit. All Difficulty levels and Arrow Speeds shall be pre-determined for round one. Difficulty and Arrow Speeds shell be preset as follows: (1) Youth Division (ages – 8 through 12) - shall be set at Difficulty and Arrow Speed “LIGHT”; (2) Teen Division (ages 13 through 17) shall be set at Difficulty and Arrow Speed level “STANDARD”; (3) Adult Division (ages 18 through 32) shall be set at Difficulty and Arrow Speed level “EXPERT OR ADVANCED”. At each Round One (1), PRELIMINARY WINNERS will be selected. Before becoming OFFICIAL WINNERS, each Preliminary Winner must meet all criteria as defined herein and may be disqualified at any time based on the requirement to complete all paper work related to the 2010 US DDR Tournaments, their conduct, and/or the determination that said Preliminary Winner achieved victory in violation of the rules as defined herein. OFFICIAL NOTIFICATION shall be completed after the event and Preliminary Winners from Round One shall be notified immediately following the conclusion of their respective location’s Tournament. Preliminary Winners of Round Two Tournaments will be notified at the conclusion of the Round Two event and verified via email upon completion of all requirements as defined herein. Winners, as defined herein, shall then be invited to compete in the Round Three finals Tournament.
8. 2010 DANCEDANCE REVOLUTION US TOURNAMENT ROUND TWO (2) SUMMARY: Total participants for each 2010 DanceDanceRevolution Round two will be limited to participants in age divisions eight (Age 8) through thirty two (Age 32) as defined by Division herein. All registrations are to be completed according to the registration process as defined herein by tournament administrator. Online registration for Round Two Tournaments must be completed by the Parent or Legal Guardian of eligible deemed minor participants as defined herein. On the day of the Round Two Tournament each registrant is expected to arrive at the appointed time, based on the registration email sent upon completion of registration from Round One. Upon arrival at the tournament location, each registrant is required to complete the Check-In process. On the day of the Round Two, each registrant is grouped by Age Division. Each age level grouping will have a specified time and date play window of tournament play. Administrators will select time and place for all competitions. Each Participant will select one song from the list of 3 songs on the preset song list to compete too. The fourth (4th) song on the preset song list will be used for Tie-Breakers only. Any and all scores resulting in a tie will result in a Tie-Breaker round using the fourth (4th) song from the preset list and predetermined Difficulty and Arrow Speed based on criteria herein. Tie breakers will be conducted immediately following each round of play, high score determining the winner of the tie breaker. All participants will have one Turn of Play. All Difficulty levels and Arrow Speeds shell be pre-determined. Difficulty and Arrow Speeds shell be preset as follows: (1) Youth Division (ages – 8 through 12) - shall be set at Difficulty and Arrow Speed “LIGHT”; (2) Teen Division (ages 13 through 17) shall be set at Difficulty and Arrow Speed level “MODERATE OR STANDARD”; (3) Adult Division (ages 18 through 32) shall be set at Difficulty and Arrow Speed level “EXPERT”. Round Two, is structured as follows: Round One (1) competition is a single turn elimination round to 16 participants. Round two (2) is head to head and the winner is determined by the High Score and is single elimination. If, in Round One, there are an odd number of participants in any group, then the odd numbered participant competes alone. The winner’s score in Round One is determined by multiplying the number of “difficulty blocks” the song has (i.e. a score of 100,000 on a 7 difficulty block song comes to a final score of 700,000). This score is presented at the conclusion of each competitor’s play in each round. ONLY THE OFFICIAL ADMINISTRATOR’S REPRESENTATIVE may determine the winner. In Round One, each participant’s arrow speed and difficulty level are set. Following Round One all play is HEAD-TO-HEAD and the low score, no matter the format, is eliminated. The high scores in each corresponding age level grouping in Round One are the Winners of Round One and proceed to Round Two. Following Round One all winning scores are determined by the number of “Perfect” steps of each competitor. For Round Two, all matches are head-to-head and are paired by ‘seeding’. During the Regional Tournament the first Round of Play is a single elimination round. The top 16 move on to the next level of play of the Round Two (2). In Round Two the song selection is pre-determined. The top 16 participants are seeded paring the highest score against the lowest score from the previous elimination round in head-to-head play, the top score wins. Each player’s arrow speed and difficulty level are determined pre-determined by tournament administrators. The winner of Round Two is determined by the score of the number of “Perfect” steps. The top 8 scores move onto the next level of play, Round Three. The same process applies to Round Three. Song selection is pre-determined. The winner of Round Three is determined by the score of the number of “Perfect” steps. The top 4 scores move onto the next level of Play, Round Four. In Round Four of the Regional Qualifier Tournaments the winner is determined in a “Best Two-Out-of- Three” (2 wins out of 3 matches) format. Each competitor in Round Four is allowed to select one song at the outset of their head-to-head play from the set song list. The determining song or songs after the participants select their initial song are selected randomly. The winner of Round Four is determined by the score of the number of “Perfect” steps. The two lowest scores from Round Four Move onto Round Five and play head-to-head to determine a Third Place winner. Round Five follows the same “Best Two-Out-of-Three” format as Round Four. Round Six – the Final Round – determines the Tournament Winner and follows the same “Best Two Out of Three” format as Round Four. The winner of Round Six is determined by the score of the number of “Perfect” steps. The Champions will be announced at the live event; however, these results are preliminary until each prospective Winner completes the required tasks in order to be named the Official Winner of the Regional Tournament. Official Notification of the winner of the Tournament will be issued in writing, via email within 7 business days. If the winner(s), in any portion or the Tournament fails to complete all required steps as defined herein, then an alternate finisher shall be named the winner and so on or until a when a winner is identified. Tournament Winners may NOT use surrogates or substitutes UNDER ANY CIRCUMSTANCES. Any such action shall be cause for immediate disqualification from the Tournament.

9. OVERVIEW OF 2010 DANDCEDANCEREVOLUTION US TOURNAMENT ROUND THREE (3) SUMMARY: Participants in the 2010 DanceDanceRevolution US Round Three (3) portion of the Tournament are determined as the result of the OFFICIAL OUTCOME of each of the Round One and Round Two portions of the Tournament. In order to qualify for the US Finals, you must be a WINNER OF EACH CATEGORY who BOTH WINS THEIR CATEGORY AND HAS ONE OF THE TOP OUR SCORES FROM ALL REGIONALS. If for any reason a Round Two Tournament is cancelled, then additional participants will be named by random selection from the alternate top scorers from the Round Two (2) finishers and so on, until the field is filled. The format for the Tournament is head-to-head. Head-to-head play is defined as one participate playing against another participate and the winner of that match moves on in the tournament. The results of head-to-head play are self contained, meaning the results pertain to that mach only. Seed levels will be determined randomly in order of play. Seed levels are defined as the “seeding” of one participate against an opponent for the purposes of competitive play. The format for each head-to-head match is “Best-Two-Out-of-Three” for the Round. Each player may select their arrow speed and difficulty level at the start of each round and may not change these selections until the next round. There are a total of 3 age divisions. Total participants for each 2010 DanceDanceRevolution Round two will be limited to participants in age divisions eight (Age 8) through thirty two (Age 32) as defined by Division herein. All registrations are to be completed according to the registration process as defined herein by tournament administrator. Each player’s arrow speed and difficulty level are determined pre-determined by tournament administrators. The winner of Round Two is determined by the score of the number of “Perfect” steps. The top 8 scores move onto the next level of play, Round Three. The same process applies to Round Three. Song selection is pre-determined. The winner of Round Three is determined by the score of the number of “Perfect” steps. The top 4 scores move onto the next level of Play, Round Four. In Round Four of the Regional Qualifier Tournaments the winner is determined in a “Best Two-Out-of- Three” (2 wins out of 3 matches) format. Each competitor in Round Four is allowed to select one song at the outset of their head-to-head play from the set song list. The determining song or songs after the participants select their initial song are selected randomly. The winner of Round Four is determined by the score of the number of “Perfect” steps. The two lowest scores from Round Four move onto Round Five and play head-to-head to determine a Third Place winner. Round Five follows the same “Best Two-Out-of-Three” format as Round Four. Round Six – the Final Round – determines the Tournament Winner and follows the same “Best Two Out of Three” format as Round Four. The winner of Round Six is determined by the score of the number of “Perfect” steps. The Champions will be announced at the live event; however, these results are preliminary until each prospective Winner completes the required tasks in order to be named the Official Winner of the Tournament. Official Notification of the winner of the Tournament will be issued in writing, via email within 7 business days. If the winner(s), in any portion of the Tournament fails to complete all required steps as defined herein, then an alternate finisher shall be named the winner and so on or until a when a winner is identified. Tournament Winners may NOT use surrogates or substitutes UNDER ANY CIRCUMSTANCES. Any such action shall be cause for immediate disqualification from the Tournament. Participants may select one song each from pre-set song list. All additional songs will be selected randomly. The winner of each round is determined by the score of the number of “Perfect” steps. In each round participants can select the arrow speed for their head-to-head match.
10. TOURNAMENT PRIZES: Round Two (2) Regional Official Winners will be awarded per age division. Said Round two (2) Regional Official Winners shall be deemed the Official Winners of each respective Round Two (2) Regional Tournament based on meeting the criteria as defined herein and shall be awarded trophies as prizes. The First Place Winners for each Age Division of the Round Three will receive a championship trophy, and a $250.00 gift card. The Second and Third Place finisher will receive for each Age Division of the Round Three will receive a championship trophy. The First, Second and Third place Winners will receive a trophy. Limit one (1) 2010 DanceDanceRevolution US Championship Tournaments Champion Prize winner per person/family/household per Age Division. Prizes are not redeemable for cash or transferable and no substitution is allowed except, at Tournament Administrator’s sole discretion, a prize of equal or greater value may be substituted at any time. All taxes are solely the responsibility of each Qualifier Tournament Official Winner, who will each receive an IRS Form 1099 reflecting the final actual value of his/her prize(s). Disqualification and the selection of alternate Prize winners may result from any of the following: (1) potential Winner's failure to accept a prize within the Administrator selected time period after notification; (2) the return of any e-mail notification as undeliverable after three (3) attempts; (3) the return of any other notice as undeliverable; (4) potential Winner's failure to provide the Tournament Administrator with satisfactory proof of age, identity and residency; (5) potential Winner's failure to execute and return any Affidavit/Release Document within five (5) days of receiving it; (6) potential Tournament Prize Winner's failure or refusal to be available to make the Trip and/or compete in the 2010 DanceDanceRevolution Regional or National Tournament Championship; (7) potential Winner's failure to deliver any such other documentation as the Sponsor may require at its sole discretion; and (8) any other non-compliance with Official Rules. Upon receipt of all required documentation and verification that the potential Tournament Winner has met the eligibility requirements, the Sponsor will announce the Tournament Prize Winners at the live event and the Official Winners on the tournament website.

12. PRIVACY: During the registration process, US Championship Tournaments Administrators/Partners registering their Tournament Location for the Tournament are asked to provide the Tournament Administrator with their Tournament Location name, address, first name, last name, email address, and are asked to answer a series of questions pertaining to their registering as Tournament Administrators. Registering Administrators/Partners will be also be asked to confirm that they are opting in to receive communication from Konami Digital Entertainment in reference to the Tournament and their prospective role as Tournament Administrators, opt in to adhere to the Official Rules of the Tournament, and opt in to adhere to the Privacy Policy for the Tournament. Minor participants in round two and three will be required to provide written consent from their Parent or Legal Guardian regarding their participation beyond round one in the Tournament. Participants and/or their Legal Guardian have will then are asked to complete an online registration form in order to provide their contact information for communication pertaining to round two and round three of the Tournament. Any information pertaining to any Minor Participants in the Tournament requires parental permission. Participants will be able to opt-in or opt-out from usage of personal information in receiving communications that is not in the administration of either the round two and round three Tournaments. If participants opt in to receive information from Sponsor, their email address and registration information will be provided to Sponsor for additional communication. All personal information collected will be used by Administrator only for the purposes of administering the Qualifier Tournaments and US Regional Qualifier Tournament. 13. GENERAL CONDITIONS: Each registered participant by entering the Tournament agrees that: (1) he/she will abide by and be bound by the Official Rules and the Sponsor's and Administrator's decisions, which are final as to all Tournament matters; (2) all Entries or other materials provided or captured, either online or the live Tournaments become solely the Sponsor's property and will not be acknowledged or returned; (3) this Release does not make any representation, warranty or guarantee, express or implied, relating to the Tournaments; (4) Sponsor may film any portion of the Tournament(s) and use such footage as Sponsor deems fit; (5) The name, voice, likeness, image, video, or biographical data otherwise obtained and any other materials submitted by participant or captured by Sponsor, the Administrator, or any agency or assign in any media or format now known or hereafter devised, including the Internet, for any purpose related to the Tournament, including, without limitation, in and in connection with the, Website and/or the 2010 DanceDanceRevolution National Championship Tournament Program is the sole property of the Sponsor; (6) in the event unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Tournaments, so that it cannot be conducted as originally planned, except where prohibited by law, the Sponsor has the right to cancel, modify, terminate or suspend the Tournament at its sole discretion; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; (7) the Releases are not responsible for typographical or other errors in the offer or administration of the Tournament, including but not limited to: errors in the advertising, Official Rules, selection and announcement of the winners and distribution of the prizes; (8) any portion of any prize not accepted or used by any winner will be forfeited; (9) the Releases are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; (10) Sponsor has the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the systems required to conduct any portion of the Tournament, or operate the Website, or who is otherwise in violation of these Official Rules; (11) all issues concerning the construction, validity, interpretation and enforceability of these Official Rules, and the rights and obligations of the Tournament, shall be determined by Sponsor in its sole discretion and governed by California law without regard to any conflict of laws principles; (12) Sponsor may assign all or any rights granted by Tournament hereunder to any party at Sponsor's sole discretion; (13) Sponsor has the right to amend the Official Rules, from time to time, at its sole discretion, and to cancel or postpone the Tournament; (14) the Sponsors, its agencies and assigns shall not be responsible or liable for, and are hereby released from, any and all claims, injuries, costs, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from participation in the Tournament, or any Tournament-related activity, or from the award, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize or from any interaction with, or downloading of, computer Tournament information (“Claims”); (15) Participants will not hold the US Public location, system, affiliated sponsors or agencies and or Konami and its subsidiaries if a Claim injuries, costs, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from participation in any portion of the Tournament(s), or any Tournament-related activity; (16) If a Claim arises that cannot be waived or barred, Participant’s sole remedy is at law; and (16) Participant expressly waives and relinquishes all rights and benefits afforded by Section 1542 of the Civil Code of the National of California with respect to any Claim, and does so understanding and acknowledging the significance of such specific waiver of section 1542, which states as follows: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” Thus, notwithstanding the provisions of Section 1542, and for the purpose of implementing a full and complete release and discharge by the Participant of the Releases, Participant expressly acknowledges that this document is intended to include in its effect, without limitation, all claims and causes of action relating to any Claim which Participant does not know or suspect to exist in his/her favor at the time of execution hereof, and that this document contemplates the extinguishment thereof.
